Error to the Court of Civil Appeals for the Fifth District, in an appeal from Grayson County. Carter sued the railway company and recovered a judgment for damages for personal injury, which was affirmed on appeal by defendant, who thereupon obtained writ of error from the Supreme Court.

This writ of error is prosecuted by the railway company from a judgment of the Court of Civil Appeals for the Fifth District affirming a judgment of the District Court against plaintiff in error in favor of Carter, suing by next friend, for damages for personal injuries caused by his being run over by one of the plaintiff in error’s electric street cars in the city of Denison.
