On January 24, 1930, Magnolia Petroleum Company was engaged, among other things, in operating in its business, heavy trucks and motor vehicles over the Bankhead Highway in Mitchell and Howard counties. On that date a large truck alleged by plaintiff to be “such as is ordinarily used by oil companies in the transportation of heavy machinery, equipment and supplies,” and being at the time heavily loaded with machinery of some sort, was in sole charge of, and operated by, G.
