After a jury trial in the Superior Court, the defendant, Robert Aguiar, was found guilty of murder in the first degree, and of unlawfully carrying a firearm. The defendant’s motion for required findings of not guilty, filed at the close of the Commonwealth’s case and renewed at the close of all the evidence, was denied. On June 11, 1984, the defendant filed a timely notice of appeal and a motion for a new trial. On March 18, 1985, the defendant filed a motion to set aside the verdict pursuant to Mass. R. Crim.
