I. Introduction
Roger Duguay (the “plaintiff’) brings suit against the City of New York (the “City”), F.J. Sciame Construction Co., Inc. (“FJS”), Baroco Contracting Corp. (“Baroco”), Manetta Industries Inc. and Manetta Enterprises Inc. (together “Manetta”), and Consolidated Edison Co. of New York, Inc. (“ConEd”) (collectively the “defendants”), seeking damages arising from an accident that he alleges was caused by the negligence of defendants.
