The plaintiff, Rosa Mae Howard ("Howard"), appeals from a summary judgment for the defendant, Mutual Savings Life Insurance Company ("Mutual Savings"), in an action to recover for fraud. We affirm.
In December 1983, Rosa May Howard's husband, Hills Howard, was diagnosed with cancer, and he was hospitalized three times for treatment before his death on January 27, 1984. At the time of her husband's death, Howard was paying premiums to Mutual Savings for several health insurance policies then in effect for her and her husband.
