The first count of the indictment charged the defendant with the forgery of a miners’ certificate, purporting to be issued by the miners’ examining board of the third inspection district in the anthracite coal region of Pennsylvania, and certifying to the competency and qualifications of one Peter Chapulis, entitling him to be employed as a miner. The second count charged the defendant with *557fraudulently and knowingly uttering the said forged certificate. The appellant was acquitted upon the first count of the indictment and found guilty and sentenced upon the second count.
