The Chesapeake Bay Foundation (CBF) and the Natural Resources Defense Counsel (NRDC) filed suit against Bethlehem Steel Corporation for alleged violations of the Federal Water Pollution Control Act, 33 U.S.C. § 1251 et seq. (Clean Water Act), specifically Sections 301 and 402 of the Act, 33 U.S.C. §§ 1311, 1342. Plaintiffs claim that defendant has not complied with the waste water discharge limits contained in its National Pollutant Discharge Elimination System (“NPDES”) permit.
