I. NATURE OF THE ACTION AND PRIOR PROCEEDINGS

This case is before the court as a result of the Eleventh Circuit Court of Appeals’ January 9, 2003 mandate 1 vacating the bar provisions contained in the March 4, 2002 final judgment entered by United States District Judge H.
