MEMORANDUM OPINION AND ORDER

NEESE, District Judge.

The third-party defendant Kent Uniform Company (Kent) moved the Court to dismiss the third-party claim against it herein on the ground that same is not authorized by Rule 14, Federal Rules of Civil Procedure. The Court, having suggested at the pretrial conference that a motion to dismiss such third-party claim for its failure to state a claim upon which relief can be granted might be in order, and the present motion essentially contending that, the Court hereby TREATS such motion as one for the dismissal of the third-party claim herein for the…
