Appeal from a corrected order of the Family Court of Essex County (Meyer, J.), entered December 28, 2009, which granted petitioner’s application, in a proceeding pursuant to Family Ct Act article 6, to modify a prior order of custody.
Petitioner (hereinafter the father) and respondent (hereinafter the mother) are the unmarried parents of a daughter (born in 2001). The parties are lifelong residents of Ohio, where their child was born and where they resided together off and on for seven years. In September 2007, the father was convicted in Ohio of a felony and served six months in jail.…
