GUIN, District Judge.
This cause came on for hearing before the Court on November 22, 1976 on the plaintiff’s Rule 37(b) motion to dismiss or strike the defendants’ “Petition for Permission to Process Adverse Action Against Bertram Perry.” At the same time, the Court has considered the question of the extent to which there remains an actual controversy' in this case. Based on the factual circumstances here present, the Court finds as follows:.1.
