OPINION

BAKER, Chief Judge.

Appellant-plaintiff John Barker appeals the grant of summary judgment in favor of the appellee-defendant Office of the Adjutant General of the State of Indiana (Adjutant General), after the Military Department rejected his request for reemployment and benefits in a civil service position. - Specifically, Barker argues that his action against the Adjutant General for reinstatement and for damages was not subject to summary judgment because a genuine issue of material fact exists whether he intended to engage in "career" or "noncareer" military service.
