Appeal from a judgment of the Court of Claims (Hard, J.), entered July 9, 2013, upon a decision of the court in favor of defendant.

The underlying claim arises out of a motor vehicle accident that occurred at the intersection of DeWitt Mills Road and State Route 32 in the Town of Rosendale, Ulster County on April 13, 2006.
