David Lipman, the appellant, was arrested and imprisoned by the sheriff of Cook county under a capias ad satisfaciendum issued upon a judgment rendered by the circuit court of Cook county for $3000 in favor of the appellees, Arthur V. Goebel and Edward Schatz, against the appellant, in an action on the case. The judgment was originally obtained for $6000= The cause was appealed to the Appellate Court for the First District.
