This is a suit brought by J. C. Sale, the purchaser of certain real estate, against Robert L. Figg, the seller thereof, to recover damages for the latter’s failure to correct certain defects in the building on the land, and to furnish the purchaser a policy of title insurance, in accordance with the terms of an oral agreement alleged to have been made contemporaneously with the contract of purchase and sale, and all of which the purchaser claims was a part of the inducement and consideration for his agreeing to buy the property.
