(After stating the foregoing facts.)
The plaintiff filed demurrers, both general and special, to the answer of the defendant setting up an equitable defense to the suit. These demurrers were overruled by the auditor, and the plaintiff filed exceptions to this ruling. The court below overruled the exceptions filed by the plaintiff. And correctly so, we think. In so far as the allegations of the answer were open to the special demurrers, the amendments made cured the defects; and the general demurrer going to the entire answer was properly overruled.
