OPINION OF THE COURT

ROSENN, Circuit Judge.

This unusual appeal by the Government from a judgment of acquittal entered by the United States District Court for the District of New Jersey depends largely upon an analysis of the trial judge’s comments during trial and the characterization of his order at the close of the case.
