This suit was brought in tbe Pulaski Circuit Court in Chancery, by Matthew Cunningham, against Chester Ashley and Boswell Beebe, in which the complainant set up title to the south - east quarter of section three, township one north, range twelve west, under the pre-emption act of the 29th May, 1830, which tracts the defendants had entered with pre-emption floats, over the superior equity of complainant.
