Appeal from an order of the Supreme Court, Herkimer County *1454(Michael E. Daley, J.), entered October 5, 2007. The order, insofar as appealed from, denied that part of plaintiffs motion seeking an evidentiary hearing with respect to temporary custody of the parties’ children and visitation with them and granted temporary custody of the children to defendant and visitation to plaintiff.

It is hereby ordered that the order insofar as appealed from is unanimously reversed on the law without costs, plaintiffs motion is granted in its entirety and the matter is remitted to Supreme Court, Herkimer…
