BURNS, District Judge.

Petitioners were convicted April 120, 1926, of a violation of section 39 of the Penal Code (18 USCA § 91) by giving a bribe to a federal prohibition officer, and were each sentenced to pay a fine of $1,500 and to serve a term of two years in the United States penitentiary at Atlanta, Ga.

Execution of this judgment was suspended by supersedeas, and the defendants wero released on bail pending a decision by the Circuit Court of Appeals on writs of error. On March 3, 1928, the Circuit Court of Appeals affirmed the judgment of conviction as follows: “It is now here ordered…
