Plaintiff Marine Midland Bank (“Bank”) brought this diversity suit to recover mo*1476nies allegedly due from defendant John Kilbane under a written guaranty dated August 2, 1976. Both parties moved for summary judgment. On June 7, 1983, the Court issued a Memorandum resolving all but one of the issues raised in the summary judgment motions in favor of the Bank.
