This is the third appeal in this cause, having been twice appealed to the Supreme Court. The decisions of that court upon the two appeals are reported in 79 Texas, on pages 602, 603, and 604, and in 83 Texas, from page 635 to page 649.
The appellant sues the appellees for the recovery of commissions upon the alleged sale of certain lands belonging to the estate of appellees’ testator, made by appellant, under an alleged contract between him and ap pellees, by which appellant was engaged to make sale of said lands for appellees.
