The claimant in this case entered into a contract February 3, 1902, with the Engineering Department of the United States Army to furnish and deliver on board of cars, Minnesota Transfer, Minn., the steel work for certain bear-trap sluice gates which were to be used in connection with the improvement of the Mississippi River between St. Paul and Minneapolis, for the sum of $14,957. When final settlement was made with the contractor, the Auditor of the Treasury for the War Department, upon the advice of the Comptroller of the Treasury, withheld the sum of $6,662.40 as loss, damage, and expense…
