Today, the majority judicially creates new procedures, a heightened evidentiary standard, and compelled discovery for workers’ compensation hearings. The majority exercises its creativity at the expense of Michigan workers, whom this opinion places at “significant risk.” Ante at 283. Because these new provisions subvert the will of the Legislature, ignore the language of the Worker’s Disability Compensation Act (WDCA), and recklessly risk the well-being of Michigan workers, I dissent.
