Pending before the Court are all of the defendants’ motions to dismiss this adversary proceeding brought by the Official Committee of Unsecured Creditors (the “Committee”) (ECF Doc. #’s 11, 16, 21, 24, 27, 31). Repeat corporate bankruptcies, sometimes by the same debtor and sometimes by a successor entity, particularly under current economic conditions, are, unfortunately, not uncommon.
