Appellant Houston Business Journal, Inc., (“Journal”) appeals from the denial of its motion to compel the production of documents from the Office of the Comptroller of the Currency (“Comptroller”). The Journal seeks to use the documents in a libel action in Texas state court in which the Journal is the defendant and the Comptroller is not a party.
