Appeal by relator from a judgment of the district court for Hennepin county, entered pursuant to the order of Frederick V. Brown, J., discharging an alternative writ of mandamus which directed respondent as mayor of Minneapolis to sign a contract made with relator by the city council.

The relator herein submitted its bid to the city council of Minneapolis for incandescent lighting of the streets of the city during the year 1906. Its bid was the lowest, and the council committee on gas by its report recommended that the bid be accepted and that a contract be executed by the proper officers in accordance with the terms of the bid. The council by motion adopted the report, but its action was never submitted to the mayor for his approval. Other than this the •contract was not awarded to the relator.
