Judgment and order unanimously modified on the law and as modified affirmed without costs in accordance with the following Memorandum: Plaintiff commenced this action to recover damages for injuries that he sustained while involved in the construction of a condominium project owned by defendant. He was injured inside one of the buildings when he fell through an unprotected opening adjacent to the stairwell on the second floor.
