Appeal from an order of the Supreme Court, Erie County *1112(Salvatore R. Martoche, J.), entered July 29, 2003. The order granted plaintiffs motion for partial summary judgment on liability in a personal injury action.

It is hereby ordered that said appeal be and the same hereby is unanimously dismissed without costs.
