The defendant, James F. Townsend, was jointly indicted with two others for assault with intent to mur der. Upon the call of the case the defendant elected to sever and he was placed on trial. The jury returned a verdict of guilty, of assault and battery; and the defendant moved for a new trial. His motion was overruled, and he excepted.
