MEMORANDUM AND ORDER

Pro se plaintiff Benjamin Smith (“Smith”) brings this action under 42 U.S.C. § 1983 against defendants City of Philadelphia (“the City”), Commissioner John Timoney (“Timoney”), Inspector Michael Banach (“Banach”), Captain Thomas Nestel (“Nestel”), Sergeant James Kimrey (“Kimrey”), 1 Police Officer (“P/O”) Jerold Seiple (“Seiple”), P/O Nathaniel Smith (“N.Smith”), P/O John Bender (“Bender”), and P/O Mariiza Mendez (“Mendez”).
