MEMORANDUM OPINION

CHARLES R. RICHEY, District Judge.

Plaintiff Memorial Hospital, a participant in the Medicare program, 42 U.S.C. § 1395 et seq., seeks reimbursement for certain costs of labor and delivery room services to which it is entitled as a result of recent decisions in this Circuit 1 . Plaintiff contends that the Provider Reimbursement Review Board (“PRRB”) wrongfully refused to consider Plaintiff’s appeal of the fiscal intermediary’s refusal to reopen cost reports for the 1983-85 years.
