Appeal from an order of the Family Court of Saratoga County (Hall, J.), entered February 20, 2009, which dismissed petitioner’s application, in a proceeding pursuant to Family Ct Act article 10, to adjudicate respondent’s child to be neglected.

In 2003, respondent was convicted of attempted sexual abuse in the first degree, sentenced to a year in jail and designated a risk level three sex offender for inappropriately touching a young female relative in 1997.
