The action was brought by the plaintiff on a policy of life insurance on the life of one Turley, which had been assigned to the plaintiff previous to the death of the insured on May 22, 1934. The defendant contended that the policy was not in force at the date of death on account of non-payment of a premium which became due on September 4, 1933. At the close of the entire case both parties moved for the direction of a verdict. The court directed a verdict for the plaintiff, on which judgment was entered, which the Appellate Term has affirmed, one justice dissenting.
