¶1 The Montana Municipal Insurance Authority (MMIA) appeals from the orders of the District Court of the Fifth Judicial District, Beaverhead County, granting summary judgment in favor of the City of Dillon. We reverse.

BACKGROUND

¶2 Marion Williams was entitled to receive a pension from the City of Dillon’s Police Retirement Fund, based upon her late husband’s service as the Dillon Chief of Police. She began receiving the pension benefits in 1973, and after 1980 her monthly benefit remained $480 until 2001.
