MEMORANDUM AND ORDER

I. INTRODUCTION
In its March 15, 2010 Memorandum and Order, Kenney v. State Street Corp., 694 F.Supp.2d 67 (D.Mass.2010) (“March 15, 2010 Order”), this Court dismissed all of plaintiffs claims except for a claim of negligent misrepresentation arising from an October 15, 2008, Form 8-K and Press Release by State Street. In his deposition, plaintiff Kenney revealed that he had never read the Form 8-K containing the alleged misrepresentation. Now State Street has moved for summary judgment on the remaining claim.
