Plaintiff Ochs filed this action seeking to recover certain funds paid to defendant Hoerner in connection with a multifaceted real estate transaction. Summary judgment was granted to Hoerner on Ochs’ claims and that judgment was affirmed by this Court in an unpublished opinion.

A jury trial was then conducted on Hoerner’s counterclaim seeking enforcement of a promissory note signed by Ochs. The jury returned a verdict in favor of Hoerner for $100,000, the principal amount of the note, and judgment was entered for this amount plus attorney fees, post-judgment interest,…
