The first of these cases is an action upon the bond given to the Judge of Probate by the first named defendant as one of the trustees under the will of Nathaniel Weston, with the other defendant the American Surety Company (hereinafter called the company) as surety. There was a breach of the bond, *244and judgment has been entered against the defendants for the penal sum of the bond, with interest from the date of the writ.
