One Jacob Kommers in his lifetime sued to recover from the city of Chicago damages alleged to have ■ been caused by the vacation of so much of one end of an alley as was within the right of way of the Pittsburgh and Fort Wayne Railroad Com pany, and by the elevation of the road-bed and tracks within said right of way closing the alley as a means of ingress and egress to and from the rest of the alley and appellee’s property abutting thereon.
