Plaintiff, who is defendant in error here, sued to recover damages for breach of defendant’s agreement, to secure, by February 1, 19.06, to plaintiff’s sawmill plant in Memphis, Tenn. (the. site for which was contemporaneously purchased from defendant), a track connection with the Union Railway, which was a belt line. The breach is not denied. Defendant had negotiated with the Union Railway Company a contract, afterwards executed, for the •construction by the latter of its main track upon defendant’s land, including the locating of the line upon Railroad avenue,…
