McGHEE, Justice.
Appellant’s action is brought under the Workmen’s Compensation Act.
On November 13, 1957, the appellant filed his complaint alleging that on August 22, 1956, he had been injured while working for defendant-appellee, Albuquerque Gravel Products Company. The defendant company was joined by American Employers Insurance Group, hereafter referred to as appellees. On November 23, 1957, appellees filed a motion to dismiss appellant’s complaint on the ground that it was premature and thus the trial court lacked jurisdiction to hear the case.
