The plaintiff complains of the trial of an action for damages for his ejection from a Pullman car in Oklahoma, and for his arrest, conviction, and fine for disturbing the peace. In the first count of his 'petition he alleged that at about 1 o’clock in the morning of December 31, 1910, at Kansas City, Mo., he purchased a railroad ticket of the railway company and a .ticket for a berth in the Pullman car from the Pullman Company from Kansas City to McAlester, Okl., rode thereon and occupied his berth until about 9 o’clock that morning, when at Vinita, Okl., the defendant…
