The offense is murder; the punishment, death.

In March, 1948, Betty Jane Allston, the daughter of R. L. Allston, deceased,. met appellant while each was a student in Denton, Texas. Within a period of four months the acquaintance had progressed to the point that they had become engaged to be married the following December. On the evening of July 5, 1948, appellant, Betty Jane Allston, Mrs. Allston, and the deceased met at the Allston home in Lubbock, Texas, to discuss the marital plans.
