HENDERSON, Judge.

Appellant was convicted of murder in the first degree, and his punishment assessed at imprisonment in the penitentiary for life, and prosecutes this appeal. Appellant is charged with the murder of his wife. The proof shows that defendant and his wife were occupying as a sleeping apartment the upstairs room of a building in Dallas, and that he killed his wife by striking her with an axe or bludgeon.
