Plaintiff, a seaman, instituted this action on his own behalf and as assignee of seven other companion seamen, asking judgment against defendant for wages, subsistence, and transportation from Tacoma to New York, the cause of action being based upon a contract of employment between plaintiff and his assignors, on the one part, and defendant, as owner of the SS “Timber Rush,” upon which steamer plaintiff and his assignors shipped as seamen, on the other.
