In early 1985, the United States Information Agency (“USIA” or “the agency”) terminated appellant Jan Krc’s employment in the Foreign Service. 1 After the Foreign Service Grievance Board (“FSGB” or “the Board”) ordered Krc’s reinstatement without prejudice, USIA appealed to the United States District Court for the District of Columbia, which refused to enforce the Board’s decision.
