MILLER, District Judge.

On June 11, 1938, reorganization proceedings under Chapter 77B of the Bank ruptcy Act, 11 U.S.C.A. § 207, were filed in the District Court by the Tom Moore Distillery Company. After numerous hearings and a number of unsuccessful attempts, a plan was finally submitted in November 1939 by a stockholders’ committee which was eventually approved by the Court and confirmed by order entered on January 26, 1940.
