The facts as here stated are based on the testimony most favorable to plaintiff’s right of recovery. The plaintiff at the time of the injury was 11 years of age. He was in the fourth grade at school. Fowler, the driver of the truck, asked plaintiff and his brother John, then 14 years old, to help him in delivering soft drinks from the truck he was driving, which belonged to the defendant bottling works.
