Appeal from a judgment of the Superior Court of San Joaquin County, and from an order refusing a new trial. The facts are stated in the opinion.

This is an appeal by defendant from a judgment in favor of plaintiff, and from an order denying a motion for a new trial.

The action was based upon a promissory note, and the contention of appellant is, that the contract, in the execution of which the note was given, was against public policy and prohibited by law; and so the note was void.
