BIFFERATO, Judge.

Plaintiffs, Dorothy and Richard Lacy, brought this medical malpractice claim for defendant’s reckless and negligent disregard for Dorothy Lacy’s health and safety regarding a malignant, inverted mass in her right breast. Following defendant’s demand for the convening of a Malpractice Review Panel, pursuant to 18 DeLC. § 6802, plaintiffs moved to strike that demand on the grounds that this procedure, as established by 18 DeLC. ch. 68, subchapter 3, is unconstitutional in that it is violative of the Seventh and Fourteenth Amendments of the Constitution of the United States and…
